1.Prices
Prices stated on the website include VAT and exclude shipping costs.

2. Orders
As soon as you have placed an order, you will receive a confirmation by email.
This order will show the products including VAT and shipping costs.

3. Payments

Payment must be made via the payment methods offered in the webshop. If payment by invoice has been agreed, a payment term of 14 days after the invoice date applies.

  • If the Buyer fails to pay on time, the Buyer is in default by operation of law. From that moment, the Buyer owes a contractual interest of 5% per month, as well as all extrajudicial collection costs (with a minimum of € 250,-).

  • All delivered products remain the property of the Seller until the Buyer has fulfilled all its payment obligations under the Agreement.



4. Stock
It can happen that a product is out of stock and this is not clearly indicated in the shop. We will inform you as soon as possible and, if possible, order the product promptly. As a gesture of goodwill, we will supply a similar product, provided it concerns multiple products.

5. Shipping
All shipments are handled by PostNL. Small, light items are sent as a letterbox package, larger items and orders of higher value are sent as a parcel.

6. Delivery
Ibiza Boutique strives to ship all orders within 2 working days. The risk of loss, damage, or depreciation of the products transfers to the Buyer at the moment the products leave the Seller's warehouse (Ex Works), or at the moment the products are handed over to the engaged transporter.

  • The Buyer is obliged to inspect the delivered products immediately upon receipt for visible defects, damage, or shortages.

  • Complaints regarding visible defects must be reported to the Seller in writing and with reasons within 3 working days after delivery at the latest. After this period, any right to claim lapses.

  • Invisible defects must be reported in writing within 3 working days of discovery, but no later than 2 weeks after delivery.



7. Returns

  • Since the Buyer acts in the exercise of a profession or business, the statutory right of withdrawal (the 14-day cooling-off period) does not apply.

  • Orders placed are final. Cancellation or return of delivered products is generally not possible.

 

8. Privacy
All personal data will be used exclusively for processing the order and communicating with the customer. The data will never be made available to third parties.

11. Changes to General Terms and Conditions
Love Ibiza reserves the right to amend the general terms and conditions if necessary. It is not permitted to sell Love Ibiza products on sales platforms other than your own store or website.

Ibiza Boutique takes the utmost care to ensure the reliability and timeliness of the data on the website. However, inaccuracies and incompleteness may occur.

12. Warranty

  • The warranty on products supplied by the Seller is limited to the warranty provided by the manufacturer of the products (manufacturer's warranty), unless otherwise agreed in writing.

  • The warranty lapses if the defect is due to improper use, neglected maintenance, or if changes have been made to the product by the Buyer or third parties.

13. Liability

  1. The total liability of the Seller for an attributable failure to perform the Agreement is at all times limited to compensation for direct damage and up to a maximum of the price stipulated for that Agreement (excl. VAT).

  2. The Seller is never liable for indirect damage, including consequential damage, loss of profit, missed savings, business stagnation or damage due to business interruption of the Buyer.

  3. The Buyer indemnifies the Seller against all claims from third parties that are in any way related to the products supplied by the Seller.

14. Force Majeure

  1. The Seller is not obliged to fulfill any obligation if it is hindered from doing so due to force majeure.

  2. Force majeure includes in any case: transport impediments, strikes, government measures, extreme weather conditions, non-performance by the Seller's suppliers, and disruptions in the digital (webshop) network.

15. Applicable law and Disputes

  1. Dutch law applies exclusively to all legal relationships in which the Seller is a party.

  2. Disputes between the Seller and the Buyer will initially be submitted exclusively to the competent court in the district where the Seller is established, unless mandatory law dictates otherwise.
